Mediation is a process by which all parties voluntarily decide to work towards a settlement of the divorce. Attorney Emerson of our Family Law Practice Group is an experienced mediator. In the mediation process, he acts as a neutral third party helping the couple determine points of agreement and points of contention. Then, through the mediation process, Attorney Emerson assists the parties to resolve the points of contention. Mediation can be a cost effective means by which to resolve a divorce.
Mediation requires willing participation from both sides and an ability to be open and honest in your effort to resolve conflict. The mediator does not represent either party, but rather serves to educate the parties about the law and assist the parties in reaching a mutually agreeable means by which to resolve the financial and custodial aspects of a divorce. Each party is encouraged to review all draft agreements with legal counsel of their own as the process unfolds.
